🍬 Florida Gummy Rules: Why Your Favorite Edible Might Start Looking… Pale

Florida’s Department of Agriculture recently made some changes to hemp product rules. One of the new ones? Gummies are being required to lose their vibrant colors and shift to more neutral tones (think beige or flesh-colored).

Why? Supposedly to keep them from being too appealing to kids.

Our take: Is safety important? Absolutely. But if you walk into the shop and see your cherry limeade gummies looking a little, uh… washed out don’t panic. They’re still just as effective. Just slightly less cute.

 

🛑 Texas Just Ban Vapes And It’s Bigger Than You Think

Over in Texas, things are heating up. Lawmakers passed a bill banning hemp-derived vape products. And now they’ve called a special session to try and push even more restrictions through.

Sound familiar? That’s because Florida almost passed a similar bill (SB 1698) last year. The only reason it didn’t go through? Governor DeSantis vetoed it at the last second and that decision saved a huge part of our industry.

 

💵 Why Is This Happening? Spoiler: It’s Not About Safety

Let’s be honest: the hemp industry is booming. And some very big companies  including medical cannabis players and pharmaceutical giants aren’t happy about it.

Small businesses like ours are thriving. Customers like you are getting safe, affordable access to cannabinoids without a card. And that makes the suits sweat.

So what do they do? They start lobbying. Pushing for vague laws. Trying to regulate us out of existence. Not because we’re unsafe but because we’re competition.

 

📊 Rescheduling vs. Descheduling: Why It Seriously Matters

With the federal government talking about changing how cannabis is classified, let’s clear up the two buzzwords you might’ve heard:

  • Rescheduling = Cannabis is still a controlled substance, just moved from Schedule I (where it sits with heroin - wild) to Schedule III.

    → This could give Big Pharma the keys to the industry. You’d be buying weed from Pfizer. Not the vibe. 

  • Descheduling = Cannabis is removed from the list entirely, like alcohol or caffeine.

    → This is what we should really be fighting for. It protects your access and keeps the culture alive. 

 

🌱 Hemp vs. Marijuana: Let’s Talk About It

This one gets us every time: Hemp and marijuana are the same plant. The only legal difference is the Delta-9 THC percentage by dry weight.

You read that right.

In fact, if you’ve ever seen a COA (Certificate of Analysis) from a medical dispensary in Florida -especially for edibles- it probably qualifies as hemp-derived by the government’s standards. Technically, we could sell the exact same gummy. 

So when people act like hemp is “fake weed,” it’s just not true. Same cannabinoids. Same effects. Different packaging.

Yes- hemp-derived gummies with <0.3% Delta-9 THC by dry weight are still totally legal to buy and sell.

Why do my THC gummies in FL have no color?

Florida’s new rules require less vibrant, more “neutral” colors to make products less appealing to minors. Same strength, just different look.

What happened in Texas with the vape ban?

Texas passed a bill banning hemp-derived vape products. It’s part of a growing trend of states targeting hemp access. We’re watching it closely.
